Court of Appeal gives guidance on court’s role in approving trustee decisions

The Court of Appeal has held that, when asked by trustees to sanction a momentous course of action they have decided to take, although it should act with caution it should not withhold its approval without good reason. The Court of Appeal’s analysis of previous case law, particularly judicial comment on the criteria to be used when considering different categories of trustee application, provides a good summary of the law in this area.
